VOLUNTARY SUBJECT OF NEGOTIATIONS (or permissive subject of negotiations) Other than those considered mandatory (see mandatory subject of negotiations). Either party may propose a discussion on such an issue, and the other party may voluntarily negotiate on the matter. Neither party can insist on the inclusion of a voluntary subject in a contract until an impasse. For example, the employer cannot legally insist on negotiating the method of selecting stewards or the method of conducting a strike vote. DUTY OF FAIR REPRESENTATION (DFR) – The obligation of a union to represent all persons in the collective bargaining unit in the fairest and most equal manner possible. This requirement applies to both the drafting and interpretation of collective agreements. A union is accused of breaching its duty of fair representation if a union`s conduct towards a member of a collective bargaining unit is arbitrary, discriminatory or in bad faith. For example, a union representative cannot ignore a well-founded complaint and that complaint cannot be dealt with superficially. However, it should be noted that the bargaining unit employee does not have the absolute right to file a complaint or bring it before an arbitral tribunal if it is unfounded. The union is obliged to investigate the problem and ensure fair representation for all union members as well as members of collective bargaining units who have not joined the union in the “right to work”, in open stores or in public institutions. Employers are not allowed to make decisions regarding the hiring of candidates or the dismissal or transportation of workers due to pregnancy, childbirth or related illnesses. All companies with 15 or more employees are subject to this law. The Pioneer Valley Workers` Center (PVWC) is strengthening the collective power of workers and immigrants in western Massachusetts and beyond. PvWC union leaders develop and organize grassroots campaigns for workers` rights in the food chain, including obtaining protection from wage theft, ending evictions, and building new workers` cooperatives. GLOBALIZATION – Globalization is the tendency to increase interaction between peoples on a global scale due to advances in transportation and communications technologies. Globalization is first and foremost a process of economic integration that has social and cultural aspects, but conflict and diplomacy are also a large part of the history of globalization. Economically, globalization includes goods and services, as well as the economic resources of capital, technology and data. The biggest problem for developed countries is that jobs are being lost and relocated to low-cost countries. Workers in developed countries like the United States face wage cuts from employers threatening to export jobs. This has created a culture of fear for many middle-class workers who have little influence in this global game. Large multinationals have the opportunity to exploit other countries` tax havens to avoid taxes.
TITLE VII OF THE CIVIL RIGHTS ACT OF 1964 – Title VII of the Civil Rights Act of 1964 is a federal law that protects workers from discrimination based on certain characteristics: race, color, national origin, sex, and religion. Under Title VII, an employer may not discriminate with respect to a time limit, condition or privilege of employment. Areas that may result in violations include recruitment, hiring, promotion, transfer, training, discipline, dismissal, work assignment, performance measurement, or benefit delivery. Title VII applies to employers in the private and public sectors with 15 or more employees. It also applies to the federal government, employment agencies and employment organizations. Title VII is applied by equal opportunities, Commission.No person employed by or applying for employment for an undertaking covered by Title VII may be refused employment or treated differently with regard to a decision in the workplace on the basis of racial, religious characteristics, perceived national, sexual or religious. No employee can be treated differently because of their connection to someone who has one of these protected characteristics. In addition, employment decisions should not be made on the basis of stereotypes or assumptions about a protected characteristic. For example, it is illegal for a supervisor to refuse to promote a Vietnamese person to a leadership position because he or she believes that Asians are not good leaders. TRUSTESHIP – The takeover of a local by an international union or by the federal government under the RICO Act.
